Big blow Sharad Pawar before Lok Sabha elections Election Commission considered Ajit group real NCP

New Delhi: Before this year’s Lok Sabha elections, Sharad Pawar has suffered a big setback. Because, the Election Commission has declared Ajit group as the real NCP. The Election Commission said that this decision has been taken in view of all the evidence. The Election Commission says that the Ajit Pawar faction has the right to use the NCP name and election symbol. However, the Commission has asked Sharad Pawar to give three names for the formation of a new party. These names will have to be given by 3 pm on Wednesday.

After more than 10 hearings lasting more than 6 months, the Election Commission has settled the dispute in NCP and given its verdict in favor of the faction led by Ajit Pawar. In its decision, the Commission followed the prescribed tests of maintainability of the petition, which included the test of the aims and objectives of the party, the test of the party constitution and the test of both organizational and legislative majority.

According to the Election Commission, Sharad Pawar faction could not prove majority on time, due to which things did not go in their favor. Keeping in mind the deadline for elections for 6 Rajya Sabha seats from Maharashtra, Sharad Pawar faction has been given special concession to follow Rule 39AA of the Conduct of Elections Rules 1961. He has been asked to give three names for the formation of a new party by the evening of 7th February. Many lawyers presented arguments for Ajit Pawar faction. These include Mukul Rohatgi, Neeraj Kaul, Abhikalp Pratap Singh (advocate on record) as well as Shrirang Verma, Devanshi Singh, Aditya Krishna, Yamini Singh.

Let us tell you that last year Ajit Pawar had rebelled and tore the NCP into two. He had supported the Shinde government in Maharashtra. Along with Ajit, many MLAs also joined the government. After this, Ajit claimed authority over the party and called his faction the real NCP. After this, the Speaker of the Assembly had also declared Ajit faction as the real NCP. Sharad Pawar faction challenged this decision in the Supreme Court. Now the Election Commission has also given a big blow to Sharad Pawar by calling Ajit’s group as the real NCP.

Who will be the real ‘boss’ of a party? Its decision is mainly based on three things. First- Which group has more elected representatives? Second – who has more office bearers and third – on which side are the properties. But which faction will be considered a party? Its decision is usually taken on the basis of majority of the elected representatives. For example, the group which has more MPs and MLAs is considered a party. The decision has been taken on this basis in NCP and Shiv Sena.
