Delhi High Court refuses permission for abortion to an unmarried woman who is 28 weeks pregnant

New Delhi . The Delhi High Court on Monday refused permission for abortion to a 20-year-old unmarried woman who is 28 weeks pregnant. The court said that it will not allow abortion of a fully developed fetus.

Justice Subramaniam Prasad was considering the petition, which has now been dismissed. The judge said, “I am not going to allow the abortion of a fully developed fetus of 28 weeks. I don’t see any abnormality in the fetus in the report. Feticide cannot be allowed.” The court had reserved its verdict on February 1 after the woman sought permission to medically terminate her pregnancy. Doctors refused to perform an abortion because it exceeded the legally acceptable limit of 24 weeks.

The woman claimed in her petition that she recently came to know of her pregnancy through consensual sex. The woman’s lawyer Amit Mishra said that she came to know about the pregnancy on January 25, when she was already 27 weeks pregnant. The lawyer said that her unmarried status and the confidentiality of her position within her family should be considered. Mishra urged the court to direct the All India Institute of Medical Sciences (AIIMS) to medically examine the woman, keeping in mind her mental and physical condition as well as the condition of the fetus.
