H-1B visa new rule: Relief news has come out regarding H-1B visa renewal. People living in America will now be able to renew their visas without leaving the country. Now Indians will be able to apply for H-1 visa renewal (H-1B visa new rule) even while living in America. To strengthen the H-1B registration process and reduce fraud risks, the U.S. Citizenship and Immigration Services (USCIS) has announced a final rule for the fiscal year 2025 (FY 2025) H-1B cap. This rule ensures fairness and equal opportunity for all.

Preparation to curb fraud

Registrations will be selected on the basis of unique beneficiary, thereby reducing the possibility of fraud and ensuring equal chances of selection. Starting with the initial registration period in FY 2025, USCIS will require registrants to provide valid passport information or valid travel document information for each beneficiary. The final rule outlines requirements regarding the requested employment start date on certain petitions subject to the H-1B cap, allowing filings with requested start dates after October 1 of the relevant fiscal year.

When does initial registration for the H-1B cap begin?

USCIS has the ability to deny or cancel H-1B petitions if the registration materials are inaccurate or invalid. USCIS also announced the fee schedule final rule, which will take effect after the early registration period for the FY 2025 H-1B cap. The early registration period for the FY 2025 H-1B cap will be from March 6, 2024 to March 22, 2024.

USCIS will launch the Organizational Account on February 28, 2024, which will allow collaboration on H-1B registration, petitions, and related forms. Online filing of Form I-129 and Form I-907 for non-cap H-1B petitions will also begin on the same date. While petitioners can continue to file paper Form I-129 H-1B petitions. The option of online filing will be available from April 1, 2024.

H-1B process will be completely electronic

“Improvements in these areas will make H-1B selection more equitable for petitioners and beneficiaries and will make the H-1B process fully electronic from registration to final decision,” said USCIS Director Ur M. Jaddou. It aims to improve the entire H-1B program, making it more transparent, efficient, and free from fraudulent activities.
